UN Experts Denounce Disbarment of Hong Kong Lawyer Kevin Yam

UN human rights experts have condemned the disbarment of Hong Kong lawyer Kevin Yam as an act of reprisal for his public statements regarding the independence of the region’s judiciary. Yam, who was removed from the Roll of Solicitors on July 16, 2025, had previously testified at a May 2023 hearing in the US Congress, where he raised concerns about the integrity of legal proceedings in Hong Kong. The experts asserted that Yam had not violated any legal provisions, yet faced disciplinary actions that they believe reflect a broader pattern of retaliation against lawyers advocating for rule-of-law principles.

The disciplinary proceedings against Yam were overseen by a tribunal appointed by the Chief Justice of Hong Kong, raising concerns about the impartiality of the process. The UN experts noted that such moves appear to target legal professionals who openly challenge government policies and practices, particularly following the enactment of the controversial National Security Law.

International Concerns Over Legal Freedom

According to the UN experts, the disbarment of Yam exemplifies a disturbing trend of silencing legal practitioners in Hong Kong. They emphasized that states have an obligation to ensure lawyers can perform their duties without fear of intimidation or harassment. The experts stated, “This is a new retaliation and an alarming assault on freedom of expression and lawyers’ rights to practice their profession and express their views in line with international standards.”

The implications of Yam’s case extend beyond individual rights. The UN experts indicated that this incident represents a significant violation of international law, undermining the principles outlined in various legal instruments, including the UN Basic Principles on the Role of Lawyers. These principles affirm that legal professionals must operate without undue interference, a standard that is especially critical in regions where legal systems are under pressure.

Given Hong Kong’s status as a Special Administrative Region of China, the application of these international principles is pertinent. The UN experts have formally raised Yam’s case with the Chinese government, highlighting the international community’s commitment to monitoring and supporting the rule of law in Hong Kong.
