UPDATE: Distracted driving is escalating in Durango, Colorado, with a shocking incident highlighting the dangers just days ago. On Monday, a pickup truck was struck by a Durango & Silverton Narrow Gauge Railroad locomotive. The driver admitted to being distracted at the time of the crash, raising serious concerns about road safety in the area.
Despite the Colorado Hands-Free Law implemented on January 1, 2023, many drivers appear to be ignoring the rules. The law prohibits all cellphone use while driving, including texting and holding devices to the ear. Officials are now questioning the enforcement of this critical safety measure.
The Durango Police Department (DPD) has issued just four citations for hands-free violations this year, according to a police spokesperson. Alarmingly, three of these citations were linked to crashes where careless driving was a contributing factor. The DPD clarified that the hands-free law is a secondary offense, meaning officers cannot pull over a driver solely for cellphone use unless they observe a primary violation, such as speeding.
Statewide, the situation is similarly troubling. The Colorado State Patrol has issued 498 citations for violations of the hands-free law on highways across the state. Trooper Gabriel Moltrer emphasized that law enforcement can stop drivers who are seen operating a device while driving carelessly. Examples include using a phone while navigating a construction zone or driving at high speeds with a phone in hand.
To avoid a hefty $75 fine and the potential loss of two license points, residents are urged to utilize hands-free accessories like Bluetooth headsets and dashboard mounts. The Colorado Department of Transportation encourages drivers to stay compliant to protect themselves and others.
