Brazil Increases Betting Taxes Amid Cautious Casino Legislation

UPDATE: Brazil has just announced significant changes to its gambling tax structure, as lawmakers decisively passed new legislation while maintaining a cautious stance on legalizing land-based casinos. This urgent development comes as the country seeks to boost tax revenues from gaming while navigating a complex political landscape.

The Brazilian Senate voted overwhelmingly in favor of bill PLP 128/2025 today, with a striking 62 to 6 margin. This legislation introduces immediate tax hikes for licensed sports betting operators, reducing federal tax incentives by 10% over the next two years. The tax rate on gross gaming revenue will climb from 12% to 13% in 2026, reaching 15% by 2028. These increases are expected to raise operational costs significantly as the government aims to allocate the additional revenue towards social security and public health initiatives.

Despite this decisive action, the future of land-based casinos in Brazil remains uncertain. In a separate vote, lawmakers rejected a proposal to fast-track bill PL 2.234/2022, which would legalize casinos, bingo halls, and regulated horse racing. The rejection, with a vote of 36 to 28, means the bill will undergo the standard legislative process, prolonging its potential enactment.

Opponents, spearheaded by the Evangelical Caucus, have expressed strong concerns that legalizing physical gambling could exacerbate issues such as addiction and crime, including money laundering and human trafficking. Senator Eduardo Girão called the casino proposal “deeply polarizing,” warning that economic benefits must not overshadow social costs.

On the other hand, supporters argue that legal casinos could significantly boost tourism and generate essential tax revenue, especially for economically struggling regions. As Brazil navigates this contentious debate, the government appears to favor a measured approach, prioritizing fiscal responsibility over sweeping reforms.

With President Luiz Inácio Lula da Silva now set to review the approved tax hikes, the implications of these changes will be felt across the gambling industry and beyond. Stakeholders and citizens alike are watching closely, as the outcome could reshape Brazil’s gambling landscape for years to come.
