U.S. Proposes New Rule Requiring Five Years of Social Media History

Travelers arriving in the United States through major airports, such as Los Angeles International Airport (LAX), may soon encounter rigorous digital screening measures. A new proposal from the U.S. Customs and Border Protection (CBP) would mandate that foreign visitors disclose up to five years of social media history. This requirement aims to enhance security and vetting processes for individuals entering the country.

The draft rule, filed in December 2023, targets visitors from the 42 countries participating in the Visa Waiver Program. This program allows citizens from these nations to visit the U.S. for tourism or business for up to 90 days without obtaining a visa. Under the proposed changes, travelers would need to provide their social media accounts, including usernames used in the past five years, during the application process.

The CBP has stated that this initiative is part of broader efforts to improve national security and ensure that individuals entering the U.S. do not pose a risk. Officials argue that social media platforms can serve as valuable tools for identifying potential threats, as they may reveal information about a traveler’s affiliations, intentions, or behavior.

While the proposal is intended to bolster safety, it raises concerns regarding privacy and the implications for travelers. Critics argue that requiring extensive social media history may infringe on personal freedoms and deter international tourism. The American Civil Liberties Union has voiced apprehension, highlighting that such a rule could disproportionately affect individuals from certain countries or communities.

Supporters of the proposal maintain that the benefits of enhanced security justify the need for such measures. They emphasize that similar practices are already in place for visa applicants, who often undergo thorough background checks, including social media scrutiny.

As the CBP moves forward with the proposal, it will undergo a public comment period, allowing citizens and organizations to express their views. The final implementation date has not yet been announced, but stakeholders are keenly observing how this rule may reshape the travel landscape for foreign visitors.

With increasing concerns over security, the CBP’s proposal reflects a growing trend among nations to adopt stricter entry requirements. As travelers prepare for potential changes, it is essential for them to stay informed about the evolving regulations that govern international travel.
