Air Canada Delays Flight Resumption After Union Defies Order

Air Canada has postponed its plans to resume flight operations after the union representing 10,000 flight attendants announced its intention to defy a return to work order issued by the Canada Industrial Relations Board. The airline had aimed to restart flights on Sunday evening, but the union’s stance has led Air Canada to announce a new target for resuming operations by Monday evening.

The order mandated that flight attendants return to work by 14:00 EDT on Sunday, following the government’s intervention. Earlier that day, Mark Hancock, national president of the Canadian Union of Public Employees (CUPE), stated, “Our members are not going back to work.” He criticized the process as “unfair” and indicated that the union plans to challenge the order, which it deems unconstitutional. Hancock accused Air Canada of refusing to negotiate fairly, implying that government intervention was intended to favor the airline.

The federal government’s response came swiftly, with Patty Hajdu, the federal Minister of Jobs, emphasizing that the current economic climate does not permit risks. She highlighted the significant tariffs imposed by the United States on Canada as a concern necessitating the return of flight attendants to work. Hajdu referred the matter to the Canada Industrial Relations Board for further review.

In a statement released earlier on Sunday, Air Canada had expressed optimism about resuming flights, noting it would take several days for operations to normalize. However, the airline cautioned that it may need to cancel flights over the next week as it stabilizes its schedule. On Sunday morning alone, Air Canada canceled 494 flights, adding to the hundreds canceled in previous days, affecting approximately 130,000 passengers daily.

Flight attendants initiated their walkout around 01:00 EDT on Saturday, coinciding with Air Canada’s decision to begin locking them out of airports. This escalation followed the union’s rejection of the airline’s proposal to enter into government-directed arbitration, which would involve a third-party mediator to resolve contract disputes.

The ongoing labor dispute highlights a broader context of labor relations in Canada. Following a similar situation last year, the government had compelled major railroads into arbitration during labor stoppages, a move that has drawn criticism from unions regarding the erosion of their negotiating power. The Business Council of Canada has supported government intervention in the current situation, while the Canadian Chamber of Commerce welcomed the actions taken by Hajdu.

Passengers whose flights have been impacted by the labor dispute can request full refunds through the Air Canada website or mobile app. The airline has also indicated it will explore alternative travel arrangements with other carriers, though it warns that immediate rebooking might be challenging due to high demand during the summer travel peak.

Contract negotiations between Air Canada and CUPE have been ongoing for about eight months, with both parties citing significant gaps in their positions, particularly regarding compensation and unpaid work. Air Canada’s latest proposal included a 38% increase in total compensation over four years, which the airline claimed would make its flight attendants among the best compensated in Canada. CUPE, however, argued that the proposed 8% increase in the first year was insufficient given current inflation rates.

As the situation unfolds, the airline and union are under pressure to reach an agreement that satisfies both parties while minimizing disruption to passengers. The outcome of this labor dispute will likely have significant implications for Air Canada’s operations and employee relations moving forward.
