Boston Children’s Health Physicians (BCHP) has reached a settlement agreement following a significant data breach that exposed patients’ personal information in September 2024. The medical group, which provides pediatric care across multiple states, is facing a class-action lawsuit from affected individuals who claim that the organization failed to implement adequate cybersecurity measures to protect sensitive data.
Under the terms of the settlement, BCHP will compensate only those patients who received notifications about the data breach. While the organization has not admitted to any wrongdoing, it has agreed to pay claims related to the incident. Affected individuals may receive financial compensation based on proof of financial loss, with eligible claims up to a maximum of $5,000 for those who can substantiate their losses. For others without documented evidence, compensation could be as high as $350 depending on the total number of claims submitted.
Details of the Settlement
The settlement stipulates that patients must provide evidence of financial loss to qualify for the higher compensation amount. Acceptable forms of documentation include records of fraudulent charges, identity theft expenses, or costs associated with credit monitoring. Those who cannot provide such proof may still receive a smaller amount, with potential payouts adjusted based on overall claims against the settlement fund.
Additionally, all eligible individuals will receive two years of free medical data monitoring services from Cyex Medical Shield. This service includes up to $1 million in identity theft insurance, aimed at safeguarding patients against further financial harm stemming from the breach.
The deadline for patients to request a settlement was November 25, 2025. A final hearing to approve the settlement will take place on December 10, 2025, after which payments will be processed and distributed to eligible claimants.
