Lawsuit Claims Ishbia Mismanaging Suns, Using Team for Personal Gain

BREAKING: A new lawsuit filed in Delaware State Court accuses Phoenix Suns owner Mat Ishbia of mismanaging the franchise and using it as “his personal piggy bank.” Minority owners Scott Seldin and Andy Kohlberg allege that since Ishbia purchased the team for $2.28 billion in 2023, he has pushed the once-profitable franchise into financial disarray.

The lawsuit, made public Monday, marks a significant escalation in a legal battle that has seen multiple lawsuits since Ishbia took over from former owner Robert Sarver. Seldin and Kohlberg claim Ishbia is engaging in misconduct, including a capital call on June 2, 2025, intended to pressure minority owners and dilute their shares.

In a statement, Seldin and Kohlberg assert, “Ishbia is using the Suns as his personal piggy bank,” alleging he has executed a series of conflicted transactions without their knowledge. These include extending loans to the team at exorbitant interest rates and selling naming rights to the Suns’ arena to his mortgage company, United Wholesale Mortgage, without proper disclosure.

The minority owners also claim that Ishbia mismanaged team finances, stating that the Suns and the Mercury have operated at a net loss since he assumed control. Details of these losses remain undisclosed in the latest filing but are expected to significantly impact the team’s future.

IMPACT: This lawsuit could reshape the governance of the Suns and affect Ishbia’s control over the franchise. The allegations suggest a troubling financial landscape and raise questions about the team’s operational integrity under Ishbia’s leadership.

Furthermore, Seldin and Kohlberg’s filing reveals that Ishbia’s actions are jeopardizing his ownership status in the NBA. The lawsuit claims Ishbia’s failure to fund the capital raise by the deadline could lead to a devastating dilution of his ownership interest, putting his role as team governor at risk.

In response, Ishbia has labeled the lawsuit a “shakedown.” A spokesperson stated, “This isn’t a lawsuit; it’s a shameless shakedown dressed up as legal process,” emphasizing that he intends to invest significantly in the team and its community. Ishbia further accused Seldin and Kohlberg of trying to undermine his vision for the franchise.

As the Suns prepare for their game against the Houston Rockets, the team’s record stands at 11-6. This ongoing legal drama adds pressure to both the management and the players, as the future of the franchise hangs in the balance.

NEXT STEPS: All eyes will be on the court proceedings as both sides prepare for what promises to be a contentious legal battle. Observers are keen to see how this lawsuit unfolds and what it means for the Suns moving forward.

Stay tuned for updates on this developing story as the impact of these allegations reverberates through the basketball world.
