Trump Threatens Flag Burners with Year in Prison, Claims Order

URGENT UPDATE: Donald Trump has reignited controversy surrounding flag burning by threatening legal action against Americans who exercise this constitutionally protected right. In a striking post on his Truth Social account, the former president declared that anyone caught burning the American flag will face a one-year prison sentence starting immediately.

In his message, posted last night, Trump urged ICE, Border Patrol, Law Enforcement, and the U.S. Military to enforce what he claims is part of an Executive Order issued on August 25, 2025. He stated, “You will be immediately arrested. Thank you for your attention to this matter!”

This alarming threat appears to be an attempt to bolster his previous order, wherein he labeled flag burning as illegal, asserting it “incites riots” and provokes extreme reactions among the public. However, it’s essential to note that the Supreme Court affirmed flag burning as a form of free speech back in 1989. Legal experts, including prominent First Amendment lawyer Floyd Abrams, voice skepticism about Trump’s authority to override established constitutional protections.

The implications of Trump’s statement are significant, as it reflects his ongoing campaign against certain forms of protest and dissent. Moreover, the NSPM-7 memo issued on September 25 outlines various ideological beliefs as potential indicators of “domestic terrorism,” including anti-American sentiments and hostility towards traditional views on family and religion. This expansive definition raises serious concerns about civil liberties and free expression in the U.S.
